Terms of Services

Contract

The Booking Form constitutes the entire Agreementbetween Heaven Ahead Voyage Pvt Ltd (“Operator” which expression includes allother companies/entities in its group, its operators and agents only to theextent they may provide any service or part thereof) and the Customer (whichexpression shall mean the person/s in whose name and/or whose behalf theBooking is made and/or whose name is on the Booking from, the TravelReservation Ticket (TRT)/Service Voucher/s)

Definitions

      i)Brochure” shall mean and include any printed/typed itinerary. The Brochure shall     from an integral part of these Booking Terms Conditions.

ii) "Child/Infant": "An infant means a person below the age of two years, and a “Child” means a person above the age of two and below the age of twelve years on the date of travel/tour.

iii) "Force Majeure" includes circumstances beyond the Operator’s control like acts of God/nature, major road works, traffic congestions, weather conditions, fairs, festivals, sports events, political/religious gatherings, strikes, change of management/closure of hotels/ restaurants, over booking of hotel/flights, delay/cancellation/re-routing of flights or railway, closure of/restricted entry at a place of sightseeing.

   iv) "Independent Contractor” means any hotelier/hotel owner, owner of any airlines, shipping company or railway, ferry, boat owner/ operator, cruise, coach owner/operator, transport owner/operator, owner/operator of any other person or Organisation who have been selected by the Company to render services to the Client.

Conditions of Passage/Contract

i) Only customers eligible to travel under BTQ forHoliday Tours and LERMS/BTQ as applicable for Trade fairs can participate inthose tours operating to destinations outside India.

ii) In the event the Customer makes a booking witha travel agent which involves only some travel related arrangements byOperator, customer shall be deemed to have his contract only with his travelagent who shall be solely responsible and liable.

iii) There is no contract between the Operator andthe Customer until the Operator has received the appropriate non-refundabledeposit. The full payment must be received in accordance with the Tour CheckList given to the Customer at the time of booking. If not paid in that time,the Operator reserves the right to cancel the booking with the consequent lossof deposit and apply scale of cancellation charges as mentioned underCancellations.

iv) Customer shall participate in the Tour in its entirety.The Customer will have to strictly follow the Tour Programme and return toIndia as per the validity of the air ticket. It is agreed that for allpurposes, it shall by the responsibility of the Customer to reach the place ofcommencement of the Tour and register with the representative of the Operatorat the appointed place, date and time. Operator shall not be responsible in anymanner for refund or otherwise, in the event Customer does not participate inany part of Tour and/or does not avail of the services including but notlimited to meals, rooms, entry tickets, excursions, mislaid or destroyed traveltickets or vouchers in part or whole.

v) The Operator has the right at any time and forany reason:
a) To terminate the contract after acceptance of deposit but prior to thecommencement of the tour without assigning any reason whatsoever. In such anevent, operator shall refund the non – refundable deposit and/or Tour Cost asmay be applicable. It is expressly agreed that the Customer shall not beentitled to any other amount whether by way of interest or otherwise andCustomer agrees not to make any claim therefore.
b) To alter, amend, change, modify, vary or withdraw any tour package,itineraries, tour schedule, travel plan, tour arrangements and sightseeing,holiday, excursion or facility it has advertised or published at any timewhether before or after registration or before or after the departure of thetour or to substitute an independent Contractor of similar class if it isdeemed advisable or necessary. In such events Operator shall not be liable forany additional expense or consequential loss suffered by the Customer for anyclaim on any account whatsoever.

vi) In the event of the Operator exercising itsright to amend or alter any Tour or holiday advertised in itsBrochure/Itinerary even after such Tour or holiday has been booked, theCustomer shall have the right:
a) To continue with the Tour as amended or altered, or
b) To accept any alterative Tour or holiday which Operator may offer, or
c) To unconditionally accept the return of the tour cost charges in full andfinal settlement.

vii) In any of the above cases, the Customer shallnot be entitled to, nor shall the Operator not be liable to the Customer forany damage, additional expenses, consequential loss suffered by him or to payany amount as refund. The Customer will not be entitled to make any grievancethereafter in respect of the same.

viii) In case the Customer travels on an amendedtour the legal relation between the parties shall not change only by virtue ofthe amendment. The Customer opting to continue with the tour arrangements asaltered or amended shall pay additional charges if any levied by the Operator.

ix) These conditions are applicable to everyCustomer of the Operator who books a Brochure Tour or any Special Tour ortravel arrangement. In the event of a Customer booking through Operator, a Touror Tour Arrangement of any other Independent Contractor like Carnival, Cosmos,Star Cruise etc. the “Booking Terms and Conditions” specified by such TourOperator including their payment schedule, cancellation, refund etc. shall beapplicable in addition to these “Booking Terms and Conditions” whiledetermining the independent Contractor and operator.

x) Each of these conditions shall be severable fromthe other and if any remaining provisions shall nevertheless have full forceand effect. No liability on the part of the Operator arising in any way out ofthe Contract in respect of any tour, holiday, excursion facilities shall exceedthe total amount paid or agreed to be paid for the tour holiday and shall in nocase include any con sequential loss or additional expense whatsoever

xi) All Tours/services/arrangements will be subjectto and operated/ provided in accordance with applicable laws, rules,regulations and guidelines including of the Government of India/Reserve Bank ofIndia.

Brochure

i) Brochures are printed several months in advanceand the brochure’s description of services are as accurate as possible.However, Operator does not own any hotels, airlines, restaurants, cruises orcoaches. There may be changes in the services/itinerary including for reasonsof Force Majeure / Vis Major.

ii) In case the alternate arrangements made arematerially superior as compared to the ones described in the Brochure, Operatorreserves the right to change extra for the same any time.

iii) The prices quoted in the brochure have beencalculated at the rate prevailing at the time of printing of this brochure.Operator reserves the right to amend the prices published in this brochure incase of currency fluctuations, changes in the various gross rates of exchange,and/or fuel costs, special/ high season charge levied by the suppliers, hike inthe airline/rail changes before the date of departure and to surchargeaccordingly. All such increases in price must be paid for in full before thedeparture by the Customer.

iv) No person including the Employee/s and Agentsof the Operator other than the Operator, in writing has the authority to vary,add amplify or waive any stipulation, representation, term or condition setforth herein or the Brochure.

v) Customer accepts that the Services detailed inthe Brochure are as are normally available, especially at the time the Brochureis printed, and which Operator shall endeavour to provide subject to Operator’sright to alter, amend, change, modify, change, modify, vary or withdraw thesame.

vi) In case of publication of any travel schemeoffering any discount or benefit by the Company, it shall have the sole rightto with draw such a scheme or discount at any time unless a specific assuranceto the contrary is published.

vii) Operators shall not be responsible for orbound by any printing, typographical error other such errors in the Brochure.

Tour Services

Operator undertakes to arrange for the Customer,through carriers, hotels and other providers of services, only the servicesdetailed in the accompanying brochure.

Registration

The Customer has been supplied with details for theTour arrangements and the Tour Brochure/Itinerary for the relevant year andseason. The Customer shall read the same as well as the Booking Terms andConditions and Tour Check List carefully before filling and signing the Bookingfrom. The Booking Terms and Conditions, Booking Form, Payment Receipt shall bebinding on the parties and shall constitute a contract between the parties, onthe Customer signing the Booking Form and making payment towards the prescribednon-refundable interest free deposit amount. In case of one or more but not allCustomer signing the Booking Form it shall be deemed that the others have dulyauthorized the concerning signing Customer/s.

The signing of the Booking Form by the Customershall mean acceptance in totality of the Booking Terms and Conditions containedherein by the Customer/s.

Documentation

i) Customer shall be solely responsible forobtaining his passport and ensuring that the passport is valid for minimum ninemonths from the date of commencement.

ii) Customer shall be solely responsible forobtaining all requisite visas and ensuring that the visas are valid for thefrequency/period as may be necessary for purposes of the Tour. It is theresponsibility of the Customer to furnish all documents required by theOperator for application of visa etc. UK, USA and any other visa which requirethe personal presence of the passenger will have to be obtained by customerdirectly.

iii) Customer shall be solely responsible forobtaining all requisite permissions, statutory clearances, Income Taxclearances, certificates and approvals, e.g., from the POE (Emigration) orrelated to health, insurance and shall complete all other travel formalities asmay be necessary.

iv) Customer may seek assistance of Operator forpurposes of the above mentioned documents/formalities against payment ofOperator’s fee therefore. Operator may arrange an independent agency to providesuch assistance to Customer and operator shall not in any manner be responsiblefor or liable for any act or omission of such agency.

v) Customer agrees that operator shall not beresponsible for nor liable for any error, delay, denial or other relatedact/omission by any Government authority, etc. or for any loss expense damageor cost resulting there from, credit or waiver, whether on account of travelrelated documents or otherwise, in the event Customer and/ or any member of hisparty is unable to travel due to the said reasons.

Health and Insurance

i) It shall be duty of the Customer to inform theOperator in case the Customer has any medical condition that may affect hisability to enjoy and pursue fully the Tour arrangements and wherein theinterest of the Group or any member thereof is prejudicially affected.

ii) The Operator reserves the right to ask Customerto provide written certification of his medical fitness before departure. Inthe event that a medical condition has not been disclosed the Operator will notbe liable to provide any assistance or money back.

iii) The Operator makes it a mandatory conditionthat the Customer is adequately covered by Overseas Medical Insurance policyand other appropriate Insurance Policies to cover the risk of life, limb andproperty while on tour, as the Operator will not be responsible for the same.

iv) It may be noted that the tour cost does notinclude the insurance premium and that the Customer shall have to acquire thesame at his cost.

Minimum Participation

i) The operation of tour specified in the Brochureare subject to minimum participation of paying participants, if theparticipation is below the minimum prescribed, the Operator reserves the rightto amend, amalgamate, alter, very or cancel a Tour without incurring any liabilityto pay any compensation.

ii) In the alterative, Operator may, at its solediscretion decide to operate the tour with participation below the minimumstipulated participants, or if the participants are required to travel as‘Individual Travellers’ the Operator may, at its sole discretion, apportion theextra cost amongst the remaining Customers. Persons traveling as individualtravellers in such cases will not be provided certain services including thatof tour managers and the Customers may travel with the same itinerary with someamendments, such as Seat in Coach, airport transfers which are at fixed timesetc. In the event of such apportionment, it a customer does not desire toparticipate in the Tour, he may cancel his Registration and receive full refundof the Tour Cost provided such cancellation is received by Operator no laterthan 48 hours after intimation of the extra cost.

Payment

i) Reservation on the Tour shall be accepted byOperator only upon receipt of the Booking Form duty signed along with anon-refundable interest free deposit as mentioned in succeeding paras which isadjustable against the Tour cost. It is expressly stated that these amounts mayvary from time to time after booking.

ii) The Tour Cost, as detailed in the Brochure andas may be revised, if necessary, shall be paid by Customer as follows :Non-refundable interest free deposit: At the time of booking Balance payment towords the : Thirty days prior to Tour Cost : departure of tour.

iii) If the Customer/s wishes to travel in advance,i.e. before the proposed departure date and or return after the tour ends, theCustomer/s will have to pay such extra charges as may be applicable with theminimum charge of at least Re 2,000/- as Reservation fees per person, persector, per change (subject to seats available in the same class of travel andticket validity) In case the dates requested by the Customer/s are notavailable, the Company will provide alternate dates accordingly, subject toseat availability.

iv) All payments towards the tour cost must be madeby the client to Heaven Ahead Voyage Pvt Ltd in accordance with the procedureand time frame mentioned below.

v) All payments made within 10 days prior to thetour departure date will have to be paid by online transfer / cash / Demand Draftonly.

vi) Payments made towards the foreign exchangecomponent of the tour will be calculated as per the rate of exchange of the dayof payment.

vii) Asia, Cruise Included Packages,Middle East and Islands

x) Full payment must be made in accordance with theprocedure stated above.

xi) In case of noncompliance there to by theclient, the company reserves a right to cancel the tour / booking of thenclient with subsequent loss of deposit and apply and recover the cancellationcharges as mentioned herein.

Cancellations

i) All services such as Airline seats / Hotelaccommodation / ground transportation etc. for tours are pre-blocked. IfCustomer books a third party product or servicelike Cruise/ Eurail, the Termsand Conditions and cancellation policy of such third party would be applicablein addition to the Operator Terms and Conditions. Any cancellation of tour /services has to be communicated in writing, clearly stating the reasons forcancellation.

ii) Operator is still liable to pay to allsuppliers / vendors the agreed charges including penalties, if these servicesare released /cancelled within the above mentioned time frame.

iii) If circumstances force Customer to cancel theTour, the cancellation must be intimated to Operator in writing. AllCancellations will attract Cancellation Charges as mentioned in Payment paraabove.

iv) Note: In addition to the above booking policy;for Individual/ FIT booking the following is applicable:-
a) The above is a general cancellation policy and the same is subject to changedepending on the travel date, the destination like Maldives, Hong Kong etc.,the package and the services booked and paid for.
b) For dynamic properties like Marina Bay Sands / Atlantis / Venetian etc. andReconfirmed Bookings, the above Cancellation may not be applicable and couldvary.
c) For Air tickets being issued: Full INR component has to be collected beforeissuance, else price will be subject to change.
d) In case of cruises, 100% of the cruise cost paid will be forfeited in caseof any cancellations, irrespective of time of cancellation.

Refunds

i) There is no refund payable for any utilized orpartially utilized services (e.g. Airline tickets, Meals, Entrance Fees,Optional Tour, Hotel, Sightseeing etc.)

ii) The refund for the foreign exchange componentof the tour will be refunded in INR only and will be at the prevailing day’srate of the exchanges of Heaven Ahead Voyage Pvt Ltd.

iii) If a tour is cancelled by the Operator, thenall monies will be refunded after taking into consideration the actual expensesincurred E.g. Visas, etc.

iv) Operator reserves the right to determine, inits sole discretion, the quantum of refund payable, if any, in case ofcancellation or amendment of a Tour due to Force Majeure or Vis Major. In thisrespect, the Operator may take in to account cancellation polices of andcharges levied by independent Contractors. Irrespective of the currency ofpayment which was made to Operator, the refund, if any shall be made only inIndian rupees at the prevailing rate of exchange on the date of refund as perapplicable laws, rules and regulations.

v) Refunds, if any, shall be processed with in aminimum period of 45 days of cancellation/termination.

vi) Under no circumstances whatsoever shall theOperator be liable to refund the non-refundable interest free deposit whetherthe booking gets cancelled due to failure of customer to make payment asrequired or Customer cancels the booking due to his inability to join the touras per schedule or avail of the services in whole or in part for whatsoeverreason including absence of valid documents, medical grounds or death.

vii) The Customer understands and agrees that thereshall be no refund if he does not utilize any service included in the Tour Costor paid for like meals, rooms, entry tickets, excursions, etc. nor can anyrefund be made for lost, mislaid or destroyed travel tickets or vouchers.

Forfeiture of Deposits

i) Operator shall be within its rights to forfeitthe non-refundable interest fee deposit paid by the Customer to the Operator alongwith the booking from duty signed for the tour booked by the Customer, in theevent:
a) The Customer cancels the booking.
b) The Customer does not adhere to the tour payment schedule as informed in theTour Check List.
c) In the event the visa of any country is not granted.
d) Customer is unable to travel on the tour booked by the Customer due to anyreason whatsoever, including medical.

ii) Fee deposit/s shall stand forfeited and thescale of cancellation set out herein above shall be applicable and binding.

Transportation

i) Operator shall provide only such transportationas is set out in the brochure. No transportation from or to the home ofcustomer shall be provided unless requested for separately and paid for inaddition to the Tour price.

ii) Operator operates daily seat rotation on boardits coach and therefore no seat number are allocated.

iii) There is a strict no smoking, drinking andeating policy on the buses/ coaches. If the Customer/s is/are carrying any highvalue items on the coach, the Operator advises the Customer/s not to leave thembehind when he/they leave the coach, as the Operator will not be liable in caseof theft or robbery of the said items from the coach. All baggage and personaleffects are, at all times and in all circumstances, the Customer’sresponsibility.

iv) The drivers are bound by specific Rules, likemaximum driving hours with in a day and during a week etc. Customers will haveto strictly adhere to the prescribed time table for the day so that the drivecan complete the travel, otherwise, certain sightseeing schedules may be misseddue to their actions and the same will be non-refundable.

v) In the event the Customer misses a part of thesightseeing tour or any such tour due to delay on his part, he will not beentitled to claim refund of the same.

Accommodation

i) Operator shall make all efforts to provideaccommodation in the hotels mentioned in Brochure. In the event, a particularhotel(s) is (are) not available, Operator shall provide accommodation in otherhotel(s) of similar standard.

ii) The tour is based on twin sharing or doubleaccommodation.

iii) On the tour packages, the Customer/s will beout sightseeing most of the time and hence the Operator has taken care toselect hotel which are comfortable whilst keeping cost down. The list of hotelsselected for each place are set out in the brochure. Keeping in mind theitinerary, Operator takes great care to select the locations of hotels, whichare chosen both for their comfort and value for money. Depending on the cityand the day to day itinerary and the fact that the Customer/s will be outsightseeing most of the day, the hotel may be confirmed either in the city oraway from the city centre. A double room has a queen-size bed and a twin roomhas two separate beds. Requests for double rooms will be subject toavailability and in cases when a double is not available, Operator will providethe Customer/s with a twin room.

iv) Operator recommends a maximum of only threepersons in one room. Triple rooms are usually no larger than twin rooms and thethird bed is often a roll-away bed or cot placed in a twin room. Modernfacilities such as attached toilets with showers/bath tubs are provided. Mostof the rooms have private baths or shower. Due to the favourable weatherconditions in Europe, hotels do not have air conditioners or fans.

v) It is expressly agreed that a child below 12years of age who is booked on the tour paying the special rate without a bedwill not be provided with a bed in the hotel while on the tour under anycircumstances. In case the Customer decides to makes any change in the roomingwhile on tour subject to availability, then the Customer shall be bound to payadditional amount charged to him by the concerned hotel directly to the hotel.

Meals

There are pre-set menus provided for meals on thetour. The type of meal is clearly indicated in the brochure. Unlike an airline,the Operator cannot request for a special meal, nor can it ensure a specialdiet for Customers, if applicable. The Operator, however reserves the right tochange the meal arrangement, if circumstances make it necessary to do so. Inthe event the Customer wakes up late and misses breakfast and in the event thatthe Customer is out on his own and reaches late and misses lunch and/or dinner,then no claim can be made by him for the meal which he has missed and notutilised.

Special Request

Where special requests for room allocation, dietconsideration etc. are made in writing at the time of booking, every effortwill be made to ensure that they are honoured by Independent Contractor.However Operator will not be held liable for claims of damages or consequentialloss if such requests are not honoured by the concerned independent Contractor.

Baggage

i) All baggage of Customer shall be subject tolimitations imposed by a carrier. Generally, one medium sized suit-case(30”x16”x10”) weighing not move than 20 kgs. is permitted. Customer will,however, make himself familiar with these limitations. Operator shall not beresponsible for any cost, expense damage or other exposure as a result of suchlimitations of the carrier.

ii) Customer may take out baggage insurancedirectly or through the assistance of operator against the requisite fee.

Tipping

Customer understands that it is customary to tipthe Coach drivers, porters and the guides in all parts of the world forservices rendered. The Tour Manager of the Operator will be pleased to advisethe Customer of the same.

Responsibility

i) Operator is responsible for arranging the TourServices as applicable and slated in the Brochure

ii) Customer acknowledges that Operator acts onlyas agent of the Independent Contractor and Operator is not responsible orliable for any act or omission of such independent contractors. Customer agreesthat all tickets, coupons exchange orders etc. are furnished and issued subjectto the terms and conditions herein and to the terms and conditions relating tothe service of each Independent Contractor. Customer further agrees that eachseparate contract of such independent Contractor when issued shall constitutethe sole agreement between the Customer holder and the Independent Contractor.

iii) All certificates/documents and other travelDocuments issued by Operator or otherwise issued to Customer are subject to theterms and conditions of the concerned sub-contractor, as governed by the lawsof the related country and/or applicable international conventions.

iv) Customer agrees not to hold the Operator or itsDirectors, Agents or Employees responsible, nor seek from any or all of themany amount her on account of loss damage cost expense or otherwise ofwhatsoever nature, for any act or omission not directly attributable toOperator. In the event, it is determined that the loss, damage, cost or expenseis the direct result of an intentional negligent, act or omission of Operator,Customer shall be entitled to only refund of the Tour Cost or part thereof,paid by him, as the case may be.

v) Customer agrees that he would not be entitled tomake any claim against Operator on any account whatsoever unless the same islodged with the Managing Director of Operator at its Registered Office addressnot later than 14 (fourteen) days after the culmination of the Tour along withrequisite proof.

vi) Operator is making and/or coordinating toursfor group tours, and/ or individual tours. The Operator is a Travel and holidayorganizer only. The Operator does not control or operate any airline, it doesnot own or control any shipping company, coach or coach company, hotel,transport, restaurant or any other facility or service mentioned in thebrochure. The Operator is responsible for arranging the Tour services asapplicable and stated in the brochure. Though the Operator takes care inselecting all the ingredients in the customer/s holiday, the Operator can onlyselect and inspect the. It cannot be responsible for any delay, improperservices provided by any agency, airline, transport, hotel or any provider ofservices or for any injury, death loss or damage which is caused by the act ordefault of the management or employees of independent Contractors.

vii) Operator reserves absolute right to after,amend, change or modify the Tour package, ltineraries, the Tour Schedule, theTravel plan, Tour arrangements and sightseeing. Any change in the AccommodationTransportation, ltinerary or other services, effected prior to theRegistration/departure of the tour would have been informed to the Customer atthe times of Registration/departure of Tour. However operator shall have theright at its sole discretion thereafter to change the Accommodation,Transportation, ltinerary or other services, as may be required in its solediscretion including whether they are for reasons beyond the control ofOperator or otherwise.

Liability

i) Operator shall in no circumstances whatsoever beliable to the Client or any person traveling with him for:
a) Any death, personal injury, sickness, accident, loss, delay, discomfort,increased expenses, consequential loss and/or damage or any kind of thefthowsoever caused.
b) Any act, omission, default of any independent contractor or other person orby any servant or agent employed by the provision of accommodation refreshment,carriage facility or service for the client or for any person traveling withhim howsoever caused.
c) The temporary or permanent loss of or damage to baggage or personal effectshowsoever caused including wilful negligence on the part of any person.
d) If in the event that the Customer is booked on a particular airline and thesaid flight is over booked/cancelled for whatever reason and Customer is notallowed/able to board the flight, the Customer shall not hold the Operatorresponsible for the same and no claim whatsoever can be made by the Customeragainst the Operator.

ii) Operator shall not be responsible and/or liablefor any damages caused to the Customer due to reasons beyond the control of theCustomer including Force Majeure/Vis Major.

iii) In the event that Operator is unable toconduct a particular Tour the Operator shall at its own discretion refund theamount of cost of the said Tour to the Customer without any interest on thesame The client will not be entitled to make any grievance thereafter inrespect in respect of the same.

iv) If in the event that the Customer is booked ona particular airline and the said flight is over booked/ cancelled for whateverreason and the Customer is not allowed / able to board the flight, the customershall not hold the Operator responsible for the same and no claim whatsoevercan be made by the Customer against the operator.

Communication

i) The communication directed at the address offthe customer as disclosed in the ‘Booking Form’ shall be deemed to have beencommunicated to the customer.

ii) A Travel Agent through whom a customer bookswill act to relay information from customer to operator and vice versa.Operator shall not be responsible for any error on part of such travel agent inthis regard.

Grievance

i) If the customer on an escorted tour, has anygrievance in respect of any services provided by any of the independentcontractors, the client shall immediately inform the Tour Manager in writingwith a copy to the Operator and the independent Contractor so that Operator cantake up the matter with the independent contractor and operator has the chanceto rectify the problems then and there, if the grievance is genuine. If thecustomer fails to do this, any right to compensation or refund which theCustomer may have, will be extinguished or reduced.

ii) In case of Customer is not escorted by a tour manager,any grievance concerning services of any independent contractor, should becommunicated to Operator at its registered office in writing as immediately aspossible and a copy thereof should be sent to the independent contractor,whereby the operator has the chance to rectify any problems if the grievance isgenuine. Failure to do so will result in the customer losing any right as tocompensation or refund.

iii) Any complaint by the Customer must be notifiedto the Operator in writing within 14 days of the end of the Tour as providedhereinabove. No claim notified to the operator outside this period will beentertained and the operator shall incur no liability whatsoever in respectthereof.

Withdrawal of Membership

Operator reserves the right to withdraw tourmembership from anyone whose behaviour is deemed likely to affect the smoothoperation of the tour or adversely affect the enjoyment or safety or thepassengers and operator shall be under no liability to any such person. It ishereby declared that the immunities provided under this contract shall beavailable to the Operator’s managers, including tour mangers, employees,servants and agents but not to the independent contractor selected by theOperator.

Jurisdiction

This contract and all maters and disputes arisingout of or relating to the contract shall be subject to the laws of India andcourts/tribunals forums of the National Capital Territory of Delhi shall haveexclusive jurisdiction.
